Most injured workers navigating the NSW workers compensation scheme would have likely encountered a rehabilitation provider. Their role is to prepare a return to work program at the request of the insurer. This includes conducting work capacity assessments and activities of daily living assessments.
Generally speaking, insurers will select the rehabilitation provider and seek little, if any, input from the worker. Participating in an assessment can be daunting and stressful, particularly when the rehabilitation providers are seen as setting unrealistic expectations of individuals’ capacity to work. Workers can feel pressured to return to jobs that are unsuitable or demanding of tasks that are outside of their capacity as assessed by their General Practitioner.
Workers will be pleased to know that they have a right to choose their own rehabilitation provider. This can take the stress out of the process, as it gives them the opportunity to work with local professionals who are committed to conducting fair and reasonable assessments.
